Commercial Litigation



Many different types of lawsuits fall under the broad umbrella of this type of litigation. When businesses or companies are involved in a disputes which need to be resolved through litigation, Makwela and Mabotja Attorneys is best suited to assist clients with legal advice and legal representation in this specialised field of practice.



GENERAL LITIGATION



General litigation comprise in court appearances in both criminal and civil cases, be it in the district Magistrate Courts, Regional Magistrate Courts and High Courts. Our practice specialises in this type of litigation as well, which many a times involves meticulous and diligent drafting of pleadings, notices, processes and other correspondences. Having been issued with a certificate in terms of Section 4(2) and (3) of the Right of Appearance in Courts Act, No. 62 of 1995, on 051 January 20 12, our Mr. Mabotja is capable of appearing on behalf of our clients in all the division of the High Court within the Republic of South Africa, as well as in the Supreme Court of Appeal and the Constitutional Court.



PERSONAL INJURY CLAIMS



Personal injury claims, also known as "Motor Vehicle Accident Claims" (MVA Claims) allows injured persons who were involved in a motor vehicle collision to claim certain pecuniary damages from the Road Accident Fund. The dependants of persons who have passed away as a direct result of the fatal injuries sustained in motor vehicle accidents, have a claim for loss of support as well. Our practice is well equipped to assist clients in this regard, on a contingency fee agreement basis, that is, without requiring upfront payment of our fees, in that we will only recover our fees upon successful conclusion of the claim in client's favour.



LABOUR DISPUTE RESOLUTION



Labour Dispute Resolution is a form of litigation involving employers and employees. In this regard, our practice is capable and experienced to represent either the employers or the employees, as the case might be, at all the relevant forums, including the internal disciplinary hearings, the Commission for Conciliation, Mediation and Arbitration (CCMA), Bargaining Councils, the Labour Court and the Labour Appeal Court, among others.



ADMINISTRATION OF ESTATES



Our practice specialises in this field as well; which includes estate planning, drafting of wills, formation of mortis causa trusts, winding up of estates, etcetera.



INSOLVENCY PRACTICE



Insolvency in South African law refers to a status of diminished legal capacity (capitis diminutio) imposed by the courts upon persons who are unable to pay their debts, or whose liabilities exceed their assets. Our practice is best suited to assist clients with voluntary surrenders of their estates, sequestrations, liquidations and the winding up of insolvent estates.

Many a times, medical practitioners in both the public hospitals and private practice, omit to attend to their patients with the necessary skill, care and diligence requisite in their field of practice. This includes, but not limited to, botched operations, failure to timeously and properly diagnose and treat a medical condition, failure to dispense correct and sound medical advice, prescribing and/or dispensing incorrect medication, etcetera, which then leads to the patient either dying or living with an adverse medical condition which by exercise of reasonable care and diligence could have been avoided.
